We are responsible for the processing of your personal data involved in you visiting and using the user interface on our website, https://www.mmcite.com/ (hereinafter as “the/our website”), as well as that involved in the selection of candidates for employment, and in entering into and fulfilling contracts with our customers and suppliers.

These principles provide you with information about which categories of personal data about you we process, the purposes for which we require it, the extent to which we process it, what authorises us to process it, and the period of time for which we are authorised to process it.

If you decide to enter a contract with us as a customer or as our supplier, we require the details mentioned above in order for us to enter and fulfil the contract. You provide these personal details voluntarily, nevertheless if you do not provide them, we cannot enter a contract with you. We must also fulfil our obligations stated in the legislation.

Alongside that, we can also offer you products and services similar to those you purchased from us as a consumer. You have the right to voice your objection us processing your personal data for the purpose of sending sales communications. If that objection is authorised, we will stop processing your personal data for the purpose of sending sales communications.

We also process your personal data for the purpose of finding out your satisfaction with our services. In the event that a dispute arises, we will also process your personal data for the purpose of defending our legal claims. You also have the right to voice your objection to us processing your personal data for these purposes.

You share information provided to us by email or through the careers page on our website voluntarily. However, without it we cannot include you in the selection procedure.

It can happen that at the interview for the job role someone else will succeed ahead of you. However, that does not mean that we will not want to offer you a different, suitable role at a later date. If you wish for us to contact you later in this way, we require your consent with the processing of personal data.

You can withdraw consent provided in this way at any time in whichever way is most convenient for you.

Providing these personal details is entirely voluntary from your side. However, without you providing them we cannot answer your inquiry. You have the right to object to the provision of personal data for this purpose.

4.    Whom do we grant access to your data?

We do not know exactly whom we will provide with your personal data. That is why we state here the categories of possible recipient, with the reasons why your data could end up being shared:

·       External advisors (accountants, tax advisors, lawyers)

We can entrust our professional agenda with external advisors, but only to an extent necessary to achieve a given purpose. Either we have sworn confidentiality to the advisors, or they are bound by a legal obligation of confidentiality.

·       Public authorities (courts, local authorities, bailiffs etc.) or subjects of out-of-court dispute settlements

When defending our interests, the requirement may arise to share some information about you to public authorities or subjects of out-of-court dispute settlements.

·       Persons providing marketing and graphics services

When preparing and implementing marketing campaigns (including sending sales offers), we are assisted by marketing agencies, marketing specialists and graphic designers.

·       Persons responsible for the distribution of sales communications

It could arise that by distributing sales communications, we entrust a third person, to whom we provide your personal data as part of the personal data we process for the purpose of distributing sales communications.

·       Suppliers responsible for the operation of our website and software (IT systems)

We require our providers of software equipment to be in the position of handling personal data in order for them to service our website and the operation of our IT systems.

·       Persons responsible for payment transaction services (banks etc.)

In order for us to be able to ensure thorough payment transactions (the function of payment gateways, debit payments, blocking payments, SIPO payments etc.), we must pass on your personal data to persons who are responsible for payment transactions.

·       Persons providing recruitment and agency services in a field connected with job applicants and potential employees

If we find out about your interest in a job role through a person provide recruitment or agency services, we can then under contract provide that person with information related to the candidate selection procedure.

If you want to know to whom, when, and for what purpose your data was made available, we are happy to comply.

It can happen that some of our partners (especially suppliers) are based outside the EU. In case the partner wants to access your personal data, we have ensured that the partner provides sufficient guarantees that your personal data will be safe and that your rights will not be encroached in any way.

5.    What are your rights?

As we process your personal data, you possess certain rights which we want to inform you about.

All your rights may be applied toward us in any way that suits you. It must be possible for us to check that it is actually you claiming them though (must be possible to verify your identity). We will try and compromise with you as far as possible.

G.    The right to withdraw consent

If we are processing your personal data on the basis of your consent, it is your right to withdraw that consent with the processing of personal data, including consent to be sent sales communications. You can withdraw your consent by requesting to do so at the email address [email protected].

H.    The right of access

You have the right of access to the items of your personal data we are processing. You currently have the right to information about which of your personal details we are processing, for how long, for what purpose we are processing them, whom we grant access to them, and whether we are using them for automated decision-making (and how said automated decision-making functions).

We will provide a copy of your personal data free of charge. Only in the event that multiple copies are requested may we request from you the necessary compensation for providing them.

I.      The right to rectification

If you find out that we are processing incomplete or inaccurate personal data, you have the right for us to correct it or, if required for the purpose of processing this personal data, for us to complete it.

J.     The right of erasure

You also have the right to delete the data about you which we are holding and processing. In order for us to delete it, you must request us to do so for of the following reasons:

·       your personal data is no longer required for the purpose for which it was collected or processed

·       we are processing your personal data unlawfully

·       you have withdrawn the consent that formed the basis for us processing your personal data, and we do not have any other authorisation to process this personal data further

·       you have an objection to the processing of your personal data, if this personal data was processed for the purpose of direct marketing (e.g. sending sales communications)

·       you have an objection to the processing of your personal data, which we are processing on the basis of a legitimate interest, and if we are unable to demonstrate that the legitimate interest outweighs your right of erasure

·       there exists some legal reason which requires the deletion of this personal data

·       we are processing the personal data of a child on the basis of consent, even if parental consent with the processing was given

A situation could also be reached where your personal data cannot be deleted on the basis of your withdrawal of consent with the processing of personal data or on the basis of your request for the deletion of personal data. Such a situation is especially the case when the processing of your personal data is required of us by law. In case this situation arises, we will inform you of the reason for which your data cannot be deleted.

K.    The right to portability

You also have the right to portability. If you have provided us with your personal data on the basis of consent or of it being necessary to enter and fulfil a contract, and the processing is automated, you can request the provision of the personal data which fulfils these conditions. We will provide you with it in a commonly used, structured and machine-readable format. If it is technically feasible, we will transfer it on the basis of your request to a different administrator as specified by you.

L.     The right to restriction of processing

If you have the feeling that your personal data which we are processing is incorrect, you have the right to request that we limit the processing of your personal data to just the time absolutely necessary to verify its accuracy and to amend it if appropriate.

You also have this right in the following cases:

·       the processing of your personal data is unlawful, but you do not wish for your personal data to be deleted

·       we no longer need your personal data for the purposes for which we originally processed it, but you insist on its processing (especially its preservation) for the determination, enforcement or protection of your legal rights

·       you have objected to our processing of your personal data on the basis of a legitimate interest, as part of which the restriction of processing in this case will be valid for the time necessary to determine whether our legitimate interest outweighs your right for your personal data not to be processed any further.

M.  The right to object to the processing of your personal data on the basis of a legitimate interest

If we are processing your personal data on the basis of a legitimate interest, you have the right to object to that processing. On the basis of the objection, we will consider whether it is actually in our legitimate interest to process your personal data for the given purpose, or whether our legitimate interest outweighs your right for your personal data not to be processed any further.

If your objection is authorised, we will stop processing your personal data.

N.  The right to object to the processing of your personal data for the purpose of direct marketing

You have the right to object to us processing your personal data for the purpose of direct marketing (e.g. for the purpose of sending sales communications). In such a case, we will stop processing your personal data for this purpose any further.

O.   The right to complain

If all the aforementioned rights are insufficient in your view, or if you are of the opinion that in any way we are interfering with your rights, you have the option to submit a complaint with the supervisory authority. You can lodge the complaint by contacting the appropriate supervisory authority. In the Czech Republic this is Úřad pro ochranu osobních údajů.
